5. Who Can Use Divinecart
By using the Platform, you confirm that:

- You are legally allowed to enter into a contract under Indian law.

We may suspend or close your account if we find false information, misuse, or violation of these Terms.
6. Creating and Managing Your Account

You are responsible for all activity on your account. If you suspect someone else is using your account, please notify us immediately.
7. What We Offer
Divinecart is a marketplace focused on Hindu religious and devotional products. Our services may include:

- Learning about rituals and product usage
- Connecting with approved sellers
- Tracking orders and receiving support
Some content is free to view, while products and certain services are paid.
8. Working with Third‑Party Sellers
Many items on Divinecart may be sold by independent sellers. In such cases:
- Sellers are fully responsible for the accuracy of the products they list.
- Divinecart does not guarantee or control their advice, promises, or actions.
- Any issues involving a seller’s product should be raised with the seller, though we will help mediate where possible.
We may remove sellers who violate our policies.
9. First‑Time Offers
If we provide a free first‑time experience (e.g., a trial, promo, or discount), it will be limited to one unique user per mobile number/device. Exact terms will be shown when the offer is displayed.
10. Content Rules
You must not upload or share:
- Abusive, hateful, violent, sexual, or illegal content
- Anything that may harm children or violate child safety laws
- Content that encourages discrimination, hate, or violence
- Files that contain viruses or harmful code
- Content that infringes copyrights, trademarks, or proprietary rights
We may remove such content and take further action, including account suspension.
11. Activities That Are Not Allowed
Please do not:
- Hack, scrape, or reverse-engineer any part of the Platform
- Create multiple accounts to misuse offers
- Send spam or fraudulent messages
- Pretend to be someone else
- Attempt to unlawfully access any part of the Platform
12. Orders, Cancellations & Refunds
Order Processing: We begin processing your order as soon as payment is confirmed.
Cancellations: Cancellation may be allowed only if the order has not been shipped or processed by the seller.
Refunds: Refunds may be issued in specific cases such as:
- Damaged products received
- Wrong items sent
- Order not delivered
Refunds may include deductions such as:
- Payment gateway charges
- Shipping fees
- Any other applicable costs
Refund timelines depend on your bank or payment provider.
Digital or Customized Services: Once delivered, refunds may not be possible.
Duplicate Payments: If payment is processed more than once due to a technical issue, we will refund the extra amount.
13. Calls & Communication
By using the Platform, you agree to receive calls, SMS, WhatsApp messages, emails, and notifications from Divinecart or its partners, even if your number is registered with DND.
14. Payment Terms
- Repeated refusal of COD orders may result in COD being disabled for your account.
- You confirm that the payment method you use is yours or that you are authorised to use it.
- Payment gateway failures are beyond our control.
15. Automated Suggestions & Tools
Any automated recommendations or system-generated suggestions are for informational purposes only. These are not expert or professional advice.
16. Limitation of Liability
To the fullest extent permitted by law:
- Divinecart is not responsible for indirect or incidental losses.
- All services are provided on an “as is” basis.
- We do not guarantee uninterrupted access to the Platform.
- Our total liability will never exceed the amount you paid for the specific transaction, or ₹1,00,000—whichever is lower.
- We are not responsible for delays caused by events beyond our control.
17. Your Responsibility to Us (Indemnity)
If your actions cause losses to Divinecart, you agree to compensate us. This includes violations of these Terms or infringement of someone’s rights.
18. Ownership of Content
Everything on the Platform—designs, text, graphics, logos, software—is owned by Divinecart or its licensors.
You may not copy or reuse our content without permission.
By posting content on the Platform, you grant us permission to use it (for example, in listings, promotions, or service improvements).

23. If Something in These Terms Is Invalid
If a court says a part of these Terms is invalid, the rest will still apply. Not enforcing a part of the Terms does not mean we waive our rights.
24. Governing Law & Disputes
These Terms are governed by the laws of India.
Any disputes will be resolved through arbitration in New Delhi, under the Arbitration and Conciliation Act, 1996. Proceedings will be in English.
Either party may approach New Delhi courts for urgent interim relief before arbitration is completed.
25. Entire Agreement
These Terms, along with our Privacy Policy and Refund Policy, form the complete agreement between you and Divinecart regarding your use of the Platform.
